License Agreement

1. Grant of License

Subject to the terms of this Agreement, See Sight Tours grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your personal, non-commercial purposes. This license does not include the right to:

• Resell or commercially exploit the Service or its contents
• Collect or harvest any personally identifiable information from the Service
• Use the Service for any commercial solicitation purposes
• Systematically download or cache content from the Service

2. Restrictions

You agree not to, and will not permit others to:

• License, sell, rent, lease, transfer, assign, or otherwise dispose of the Service
• Modify, translate, adapt, merge, make derivative works of, disassemble, decompile, reverse compile or reverse engineer any part of the Service
• Use the Service to send unsolicited communications (spam) to any person
• Use any automated means (bots, scrapers, crawlers) to access the Service without our express written permission
• Attempt to gain unauthorized access to any portion of the Service or its related systems or networks
• Remove or alter any proprietary notices, labels, or marks on the Service

3. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of See Sight Tours and its licensors. The Service is protected by copyright, trademark, and other laws of both Canada and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of See Sight Tours. This includes the See Sight Tours name, logo, wordmark, and all associated brand assets.

All photographs, videos, written content, tour descriptions, pricing information, and other materials on the Service are the property of See Sight Tours unless otherwise indicated, and are protected by applicable intellectual property laws.

4. User Content

When you submit reviews, photos, comments, or other content through the Service ("User Content"), you grant See Sight Tours a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Service and our business.

You represent and warrant that your User Content does not infringe the intellectual property rights, privacy rights, or any other rights of any third party, and that you have all necessary rights to grant the license described above.

5. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach this Agreement. Upon termination, your right to use the Service will immediately cease.

All provisions of this Agreement which by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

6. Disclaimer

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

See Sight Tours does not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that defects will be corrected. We do not warrant the accuracy or completeness of any information provided through the Service.

7. Limitation of Liability

IN NO EVENT SHALL SEE SIGHT TOURS, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our aggregate liability to you for any claims arising from or related to this Agreement or the Service shall not exceed the greater of (a) $100 CAD or (b) the total amount paid by you to See Sight Tours in the 12 months preceding the claim.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.
